What New Jersey law requires

Medical records

New Jersey requires a physician licensed by the Board of Medical Examiners to maintain a treatment record for seven years from the date of the most recent entry, under N.J.A.C. 13:35-6.5. The period runs from the most recent entry rather than from the start of care, so an ongoing course of treatment resets it each time the record is added to. Institutional requirements are longer and separate: a hospital retains a general medical record for ten years following the most recent discharge and a discharge summary for twenty years, and an HMO retains member records for ten years. The same regulation governs how records are transferred or disposed of, which is the part that applies when a practice engages an outside transcription provider.

The seven-year clock runs from the most recent entry, so it resets during ongoing treatment.
